Terms and Conditions for In-Person Training and Online Access

1. Definitions

  • Organizer/SellerDIGITAL BY DEFAULT ŁUKASZ SIPA, Tax ID: 7681818164, Łódzkie Province, Opoczno District, Opoczno Municipality, ul. Żeromskiego 5/16, 26-300 Opoczno, Poland.
  • Service/Store – the service available at bladehouse.academy, enabling the purchase of online courses and registration for in-person training.
  • User/Client – entity using the Service; Consumer – as defined by consumer protection laws.
  • Online Course – digital content/service made available in the Service.
  • In-Person Training – training conducted at a specific location and date.

2. General Provisions

  1. These Terms govern: purchase and access to Online Courses, and registration and participation in In-Person Training.
  2. Placing an order/registration requires acceptance of these Terms and the Privacy Policy.
  3. Information in the Service constitutes an invitation to contract, not an offer as defined by civil law.

3. Account and Communication

  • Account creation requires providing truthful information. Users are responsible for protecting login credentials.
  • Communication with the Organizer occurs at the addresses specified in §1 (Organizer details).

4. Contract Formation and Payments

  1. The contract is concluded upon order confirmation (email) and/or successful online payment.
  2. Payment methods: exclusively online electronic payments through Przelewy24 (PayPro S.A.) – including fast transfers, BLIK, cards. We do not accept cash payments or prepayments.
  3. Prices are gross prices (including VAT), expressed in PLN.
  4. Invoices: automatically sent electronically to the provided email address.

5. Online Courses – Access and Requirements

  • Access is granted immediately after payment is processed or according to course description (e.g., pre-sale).
  • Access period: unlimited. License: non-exclusive, non-transferable, for personal use only.
  • Technical requirements: current browser, stable internet connection, device with audio/video capabilities.
  • Prohibited: sharing materials with third parties, recording, and public playback of materials without permission.

6. In-Person Training – Organization and Rules

  • Training location and date are specified in the training description/confirmation.
  • Admission requirement: 100% online payment (no cash or prepayments accepted).
  • Participants must follow instructor instructions and safety/hygiene rules; behaviors threatening safety are prohibited.
  • Number of participants may vary depending on the in-person course topic. Some courses are for 1 person, others organized in groups.
  • Consent for image capture for documentation/promotional purposes is granted separately.

7. Date Change and Withdrawal (In-Person Training)

Participant/Client Rights

  • > 30 days before training date: option for free cancellation (100% refund) or free date change.
  • ≤ 30 days before training date: option for one-time date change; in case of cancellation or no-show without using the change option – payment is forfeited.
  • Cancellations/change requests must be submitted via email to: lukasz.sipa@gmail.com.

Changes Due to Organizer Reasons

  • In case of force majeure/instructor illness/insufficient minimum participants, the Organizer may change the date or cancel training; Client chooses a new date or receives payment refund.

Legal basis: Consumer rights legislation – no right of withdrawal for services related to events with specific dates.

8. Right of Withdrawal – Online Courses

  • Consumers have 14 days to withdraw from distance contracts, unless access to digital content/service began with their express consent before the 14-day period expires and they were informed of losing this right – then withdrawal does not apply.
  • Consumers have no right of withdrawal for contracts to supply digital content not supplied on a tangible medium, for which payment is due, if the trader began performance with the consumer's express prior consent after informing them of losing the right of withdrawal and the consumer's acknowledgment; the trader provides confirmation on a durable medium.

9. Complaints and Service Compliance

  • Online Courses – provisions on compliance of digital content/services with the contract apply (Directive 2019/770). You may demand restoration of compliance, price reduction, or withdrawal – for significant defects not remedied within reasonable time.
  • In-Person Training – complaints regarding organization/service quality are handled under general principles.
  • Complaint submissions: lukasz.sipa@gmail.com (subject "Complaint"), include order number, course/training, description and demand. Response time: 14 days.

10. Copyright and License (Online)

  • All course materials (video, audio, text, graphics, exercise files) are protected by copyright and belong to the Organizer or licensors.
  • Client obtains a non-exclusive, non-transferable license for personal use of the course in streaming (online) model solely within their account.
  • Sharing account with third parties, joint use of one account, and public playback of materials are prohibited.

10a. Prohibition on Downloading, Recording, and Sharing

  • Downloading video/audio files or parts thereof (including using stream ripping tools) is prohibited.
  • Screen recording, capturing audio/video, making and distributing screenshots is prohibited.
  • Sharing materials with third parties (messengers, cloud services, social/video platforms) and publishing fragments without written permission from the Organizer is prohibited.
  • Circumventing/removing technical content protections, watermarks, and identifiers is prohibited.

10b. Content Protection Measures

  • We may employ content marking (e.g., watermarks, session identifiers), concurrent device limits, anti-piracy mechanisms, and login anomaly monitoring – in accordance with law and Privacy Policy.
  • Upon justified suspicion of violations, we may temporarily suspend course/account access pending clarification.

10c. Consequences of Violations

  • In case of significant violation (particularly prohibitions in section 10a), we may immediately block the account and/or terminate the license and course access – without right to refund for the period when access was active.
  • We reserve the right to pursue civil claims (including damages, disgorgement of profits, cost recovery) and report violations to appropriate authorities – in accordance with copyright protection laws.
  • Upon demand, Client is obligated to immediately delete all unlawfully recorded or distributed copies of materials.

11. Liability and Force Majeure

The Organizer provides services with due diligence. Not liable for interruptions or limitations caused by external factors (provider failures, force majeure) when due diligence was maintained.

12. Personal Data

Data processing principles are described in the Privacy Policy.

13. Final Provisions

  • Governing law is Polish law. Consumer disputes are resolved by competent courts according to applicable regulations.
  • EU ODR Platform: ec.europa.eu/consumers/odr.
  • Terms may change for valid reasons (legal/technical changes). We will notify of changes in advance; previous orders are subject to the version from purchase date.
